How The Scottsdale City Court System Works
The Scottsdale City Court Criminal Justice System
After an arrest, the Scottsdale Police Department usually sends the incident report to the Scottsdale City Prosecutor’s Office. The assigned Prosecutor will examine the file and then determine whether their office will move forward with charging the individual involved in the report. If the Prosecutor files a complaint, the suspect will be named as the Defendant and a Summons will be mailed or served upon that individual. The Summons lists the date of your Initial Appearance, which is your first court date at Scottsdale City Court. You must attend this hearing, or a warrant may be issued for your arrest. After the Initial Appearance, a few Pretrial Conferences are set to allow the Defendant to examine the discovery and plea offer from the prosecution. A status conference may be set. The case will then move to trial if the case is not dismissed or a plea offer is not entered into by the Defendant.
Scottsdale City Court’s DUI Penalties
In Scottsdale City Court, there are several different outcomes in a DUI case. The outcome depends upon the type of charges one is facing. The charges are based upon the blood alcohol content (BAC) that the Defendant allegedly had in their system at the time of driving. There are four types of DUI charges, along with many other criminal and civil charges that can be filed by a City of Scottsdale Prosecutor. This creates a wide range of possible plea agreements.
There are many negative consequences that arise from a DUI arrest. The total fines, fees and surcharges in a DUI sentence are often high. Other consequences, such as mandatory jail, ignition interlock devices and insurance increases are difficult to manage. A Scottsdale City Court DUI conviction or guilty plea can come up in conversations during interviews, applications for licenses or other opportunities, leading to a conversation about the offense. Scottsdale’s DUI law firm, Dove Law Firm, will protect your rights and build the strongest possible defense for your case.
How To Fight Scottsdale Court DUI Charges
What do you do when you have been arrested and want to fight Scottsdale City Court DUI charges? Each case has unique challenges when dealing with DUI legal charges. An experienced Scottsdale DUI lawyer can explain the best strategies to challenge the case. A knowledgeable attorney will evaluate the discovery, police report, evidence, specific charges filed, criminal history and police conduct, including how any field sobriety tests were administered, to build a defense tailored to your case.
All potential constitutional violations and issues should be thoroughly explored because each DUI case is different, and the discovery may completely change the outcome. There are advantages and disadvantages of going to trial or taking a reduced plea deal. Dove Law Firm will give you the information you need to make the best decision for your life.

Arizona DUI And DWI Laws Drivers Should Know
Arizona has a no-tolerance policy when it comes to being under the influence and operating a vehicle. You can be arrested for a DUI even if your BAC is below the legal limit, but you are showing signs of impairment. The state breaks DUIs into three categories depending on your BAC: standard, extreme, and super extreme. Each level means more serious consequences. If you are charged with an aggravated DUI, you will face a felony.
It is also important to know that when you get your driver’s license, you automatically consent to chemical testing under Arizona’s implied consent law. This means that while you can legally refuse the field sobriety test, and lawyers often suggest you do so, you cannot refuse the chemical testing without penalties, namely an automatic one-year administrative driver’s license suspension.
First Offense DUI Misdemeanor In Arizona A.R.S. 28-1381(A)(2)
A first offense DUI that is not aggravated is charged as a misdemeanor. When arrested, you will be taken in for a blood test. If your blood alcohol level is above the legal limit of 0.08% within 2 hours of driving, no other evidence is needed to prove you were intoxicated. First offenses are taken seriously and carry a minimum of 10 consecutive days in jail. However, the judge may suspend 9 of those days if you complete alcohol screening and an education or treatment program.
First-time offenders may also have options to reduce timelines when it comes to the mandatory ignition interlock device. Anyone convicted of a DUI must install this device at their own expense for 1 full year. First-time offenders are able to reduce this to 6 months if the required steps are taken. If you are arrested for a first offense DUI in Arizona, talk to our lawyers about how to get the best possible outcome.
Second Offense DUI Misdemeanor In Arizona A.R.S. 28-1381(K)
Being charged with a second DUI offense within an 84-month period remains a misdemeanor, but will land you with much higher penalties. While a first offense only puts you in jail for a minimum of 10 days, a second offense will put you in jail for a minimum of 90 days. Like the first offense, you can take certain actions that will qualify you to suspend up to 60 days of the jail time, but you will still be required to spend 30 consecutive days in jail.
The other most significant difference between first and second DUI offenses is how it affects your drivers license. A first offense typically leads to a 90-day license suspension, while a second offense leads to a one-year revocation. Learn more about what happens to your license after a DUI in Arizona. With these serious penalties, you need to make sure you have a skilled lawyer on your side. They can help you reduce penalties and charges to ensure you protect your future and daily life.
Scottsdale DUI Penalty Levels
Penalties For A Standard DUI In Scottsdale And Arizona
While standard DUI penalties are not nearly as severe as the higher charges, a standard DUI is still taken very seriously. Even first-time offenders will face jail time, a license suspension of at least 90 days, fines, a mandatory ignition interlock device for 12 months, and more. Having a DUI on your record can impact you for the rest of your life since a DUI conviction cannot be expunged in Arizona, so having a lawyer on your case is crucial, even for a first-time offense.
Extreme DUI Charges And Penalties For BAC .15 Or Higher
If you are arrested and found to have a BAC of .15 or higher, you will be charged with an extreme DUI. While an extreme DUI is still a class 1 misdemeanor like the standard DUI, jail time is longer and fines and fees are higher. If your extreme DUI is a second offense within 84 months, you will also face a 1 year license revocation. Don’t face this charge alone. Reach out to our lawyers for help!
Super Extreme DUI Consequences For BAC .20 Or Higher
A super extreme DUI is still a class 1 misdemeanor in Arizona, but like the extreme DUI, the penalties are increased to longer time in jail, higher fines, community service, an 18-month ignition interlock requirement on a first offense, and more. Arizona is one of the strictest states when it comes to DUI consequences so be sure to have a solid DUI lawyer on your side. During your consultation, our lawyers can help you understand exactly what penalties you may be facing in your specific circumstances.
Felony DUI Penalties For Aggravated DUI Charges
The only time a DUI becomes a felony is if it is aggravated. A DUI becomes aggravated when you are driving intoxicated on a suspended or revoked license, you get a third DUI within 84 months, there was a child under 15 in the vehicle with you, and more. An aggravated DUI comes with much harsher penalties including prison time, significant fines, a one-year license revocation, and a mandatory ignition interlock device for 12 to 24 months.
What To Expect After A DUI Arrest In Scottsdale
DUI Arrest, Processing And Booking Steps
If you are pulled over and the law enforcement officer has probable cause, they can arrest you and take you to a processing center. Processing typically takes place at the police station or a processing van where you will be given a mandatory chemical test. After the test, your information will be taken including a mugshot and fingerprints. From there, you will either be released or held in custody depending on whether you’re facing a misdemeanor or felony. If your vehicle was towed, read our guide to getting your car out of impound after a DUI arrest.
Scottsdale DUI Case Timeline From Arrest To Resolution
There are several factors that play a role in the timeline of your case including the court schedule, the severity of your case, and whether or not you negotiate a plea deal. Cases that successfully negotiate a plea deal will resolve relatively quickly as compared to going to trial. Cases that involve severe circumstances may take longer whereas first offense misdemeanors may resolve quickly. Your lawyer can give you an accurate timeline based on your circumstances.
Key DUI Deadlines That Can Affect Your Case
The first deadline to remember is the administrative and driving privilege deadline. Once arrested, the officer will serve you with an Admin Per Se permit that can be used for 15 days. At the end of the 15 days, your license will be automatically suspended for 90 days. You have 30 days to request an MVD hearing, but if your request is received within the first 15 days, the suspension is put on hold until the hearing. Talk to your lawyer about the hearing process to make sure you meet these deadlines.
Driver’s License And MVD Penalties After A Scottsdale DUI
License Suspension Rules After A DUI Arrest
After a DUI arrest, you will have 15 days to drive on an Admin Per Se permit. After that, you will face a 90-day license suspension through the MVD. Additionally, you could face license suspensions and revocations through the court system.
Restricted Driving Options During A DUI Case
If your license is suspended, you may have options to obtain a restricted license. In most cases, you must serve at least 30 days of license suspension, but afterwards you could get a permit to drive to specific locations. Talk to our lawyers about your options.
Ignition Interlock Device Requirements After DUI Charges
In most cases, anyone convicted of a DUI must install an ignition interlock device at their own expense for at least 12 months, according to the Arizona MVD. Talk to our lawyers about whether you may qualify to reduce that time!
